TERMS & CONDITIONS

Scope and Acceptance of Terms

All services offered by Express Arabia are provided subject to the terms and conditions outlined below. These conditions apply to all business undertaken by Express Arabia, including but not limited to the provision of freight forwarding, cargo handling, customs clearance, and logistics support. By engaging Express Arabia, the customer acknowledges and agrees to these terms in full. Any deviation from these terms shall only be valid if agreed in writing and signed by an authorized representative of Express Arabia.

General Provisions

1.1 All and any business undertaken by Express Arabia referred to as the Company including the provision of advice information or services whether paid or unpaid is subject to these Terms and Conditions All other terms are excluded unless expressly agreed in writing and signed by an authorized representative of the Company

1.2 These Terms and Conditions apply to all services provided by the Company unless otherwise agreed in writing The Customer acknowledges and accepts these terms upon engaging the services of the Company

1.3 No agent or employee of the Company is authorized to alter or waive any part of these Terms and Conditions unless expressly authorized in writing by a senior representative of the Company

Role of the Company

2.1 The Company acts as a forwarding agent and not as a common carrier unless explicitly agreed otherwise in writing

2.2 The Company is authorized to enter into contracts on behalf of the Customer for the carriage storage handling or transportation of goods by any means and route at its sole discretion

2.3 The Company may act through subcontractors affiliates or third parties and shall not be held liable for their actions beyond what is stated in these Terms and Conditions

Authority and Warranties

3.1 The Customer warrants that they are either the owner or the authorized agent of the owner of the goods

3.2 The Customer accepts these terms not only for themselves but also on behalf of any party that has or may acquire an interest in the goods

3.3 The Customer warrants that all details including weight content and value of the goods provided to the Company are accurate and complete The Customer agrees to indemnify the Company against any losses damages or fines arising from any inaccuracies

Instructions and Discretion

4.1 The Company reserves the right to use its discretion in all matters relating to the handling and movement of goods and is entitled to deviate from Customer instructions when necessary in the interest of safety compliance or operational efficiency

4.2 The Company is not required to make any special declarations regarding the nature or value of the goods unless expressly instructed in writing

Charges and Quotations

5.1 All quotations and estimates are subject to change without notice unless confirmed in writing and accepted promptly by the Customer

5.2 The Company may revise its charges at any time due to fluctuations in freight rates exchange rates government fees or other applicable charges

5.3 All amounts due to the Company must be paid in full without any deduction or setoff The Customer remains liable for all costs including duties and taxes unless otherwise agreed

Goods Not Accepted

6.1 Unless agreed in writing in advance the Company will not accept the following goods for carriage storage or handling

  • Hazardous flammable toxic or explosive goods
  • Perishable goods or items prone to spoilage
  • Currency coins bullion precious stones jewelry antiques artworks or other valuable items
  • Live animals plants or goods likely to attract pests or disease

6.2 If such goods are delivered to the Company without prior written agreement the Customer shall be fully liable for any resulting losses damages penalties or expenses The Company may dispose of such goods at its discretion without notice

Undeliverable or Abandoned Goods

7.1 The Company may dispose of goods at the Customer’s expense in the following cases

  • If goods cannot be delivered due to incorrect or missing information
  • If the consignee fails to take delivery within a reasonable period
  • If goods remain unclaimed for more than sixty days from the date of arrival or storage
  • If goods are perishable and at risk of spoilage or damage

7.2 Reasonable efforts will be made to notify the Customer prior to any disposal The Company shall not be liable for any loss arising from such disposal

Lien and Right of Sale

8.1 The Company shall have a general and particular lien on all goods and related documents in its possession for all unpaid sums due from the Customer

8.2 If charges remain unpaid for thirty days after written notice the Company may sell or dispose of the goods at the Customer’s expense and apply the proceeds to the outstanding amounts

Liability and Limitations

9.1 The Company shall not be liable for any loss or damage arising from negligence or failure to follow instructions unless such loss or damage is directly caused by the proven willful neglect of the Company or its employees

9.2 The Company shall not be liable for any indirect or consequential loss including loss of profit or market delay or deviation howsoever caused

9.3 The Company shall not be liable for loss or damage resulting from

  • Insufficient or improper packing or labeling
  • The fragile or perishable nature of the goods
  • Riots strikes labor disruptions or acts of authority
  • Fire or natural disaster
  • Failure of the consignee to take delivery within a reasonable time

9.4 The liability of the Company in any case shall not exceed the value of the goods or a sum equivalent to five hundred Saudi Riyals per one thousand kilograms of gross weight of goods lost or damaged whichever is less

9.5 In the case of personal items or household effects the Company’s liability shall not exceed one hundred Saudi Riyals per item package or set

Claims

10.1 Any claim must be made in writing within the following timeframes

  • Seven days from the date of delivery for domestic shipments
  • Fourteen days from the expected delivery date for international shipments
  • Fourteen days from the occurrence of any other event giving rise to the claim

10.2 Claims made outside these periods will not be considered and shall be deemed waived

10.3 No claim shall be made against any employee agent or subcontractor of the Company beyond the limitations set forth in these terms

Indemnity

11.1 The Customer agrees to indemnify the Company against all costs losses penalties and liabilities including customs duties storage charges fines and legal costs whether or not arising from negligence as a result of

  • Breach of these terms by the Customer
  • Inaccurate information or misrepresentation of the goods
  • Claims made by any third party in connection with the goods or services provided

Governing Law and Jurisdiction

12.1 These Terms and Conditions shall be governed by the laws of the Kingdom of Saudi Arabia

12.2 Any dispute arising under these terms shall be submitted to the exclusive jurisdiction of the courts of Saudi Arabia
